2025 CONTEST RULES
"Valombreuse Garden 35th Anniversary Contest".

Article 1: Organization of the competition

The company: Jardin de Valombreuse, registered with the Registre du Commerce et des Sociétés under the number 84373574700019 and whose registered office is located at 36 rue de la Chapelle, ZI de Jarry, 97122 Baie-Mahault (hereinafter the "Organizer"), is organizing a free, no-obligation contest from July 09, 2025 to August 03, 2025 inclusive, entitled "35 Years of Jardin de Valombreuse Contest" (hereinafter the "Contest").

Article 2: Purpose of the game

Contest on terminal with prizes to be won to celebrate 35 years of Valombreuse botanical garden

Participation in the Game implies unreserved acceptance of these rules in their entirety, hereinafter referred to as "the Rules".

Article 2-1: Access to the game The game can be accessed at the following address: Jardin de Valombreuse, Chemin de grande savane, Cabout, 97170 Petit-Bourg

Article 3: Date and duration

The game runs from July 09, 2025 to August 03, 2025 inclusive.

The Organizer reserves the right to postpone, modify, cancel or renew the present Game if circumstances so require. In any event, the Organizer may not be held liable in this respect.

Article 4: Conditions of participation & validity of participation

4-1 Participation conditions

The Contest is open to any natural person of French nationality residing in metropolitan France (including Corsica), French overseas departments and Europe, who, at the time the Contest begins, has Internet access and a personal electronic address (email) to which he/she may, if necessary, be contacted for the purposes of administering the Contest (hereinafter referred to as the "Participant").

Persons directly or indirectly involved in the preparation of the Game, as well as members of their families (same name, same postal address), employees of the Organizer and the Organizer's subcontractors, are excluded from participation in the Game.

Only entries complying with all the stipulations of the present article will be considered.

The Organizer therefore reserves the right to carry out any checks it deems necessary regarding the identity and address of each Participant. In this respect, any information provided in the entry form which is incomplete, erroneous, falsified or which does not make it possible to identify a Participant or his/her contact details will result in the cancellation of the entry in question.

4-2 Validity of participation

Participation in the Game is exclusively on site at Jardin de Valombreuse, Chemin de Grande Savane, Cabout, 97170 PETIT BOURG, to the exclusion of any other means, including by post.

To take part in the game, you'll need to visit the site from July 09 2025 to August 03 2025, then register directly via the kiosk provided.

To validate their entry, participants must first tick the box "I have read and accept the rules" and enter their surname, first name, email address and telephone number in the form that appears.

Inaccurate information regarding identity, address or capacity, or other fields mentioned on the form, will render the entry null and void. The Organizing Company will not be able to send the prize, which will render the entry null and void.

The organizer reserves the right to eliminate from the Game any entry form that does not comply with the rules, in particular any incomplete or illegible form.

The same penalty will apply in the event of fraudulent multiple entries, i.e. beyond the limits defined in the present rules. The Organizing Body has the right to unilaterally terminate the Participant's participation, without prior notice or justification, and without this giving rise to any claim against it on the part of the Participant, particularly if the information provided is contrary to good morals and/or constitutes a denigration of the Organizing Body or its products and/or is likely to offend consumers.

Article 5: Designation of winners

The winning ballot will be drawn by a depotjeux agent on Tuesday, August 5, 2025. The result of this draw will be filed with a bailiff. The winners will be announced on August 6, 2025.

This date may be postponed if one of the operation managers designated above cannot be available on that day, and a new date will then be set for the draw.

Any ballot containing a false declaration or an erroneous and/or incomplete declaration and/or not respecting the present rules, designated by the jury will be considered null and void and will lead to the designation of another participant by a new decision of the jury.

Article 6: Prizes

6.1 -Commercial value of the prizes :

The prizes are offered by the Organizer and therefore constitute "endowments". -Total value of the prizes 10,048.50 euros including VAT.

The organizer reserves the right to change the prize without prior notice. Should this be the case, the value of the prize will be equivalent to or greater than the product replaced.

The prize may not be taken back, exchanged or exchanged for cash or cheque. Any contestation of the prize for any reason whatsoever will be tantamount to a definitive refusal of the prize.

Article 7: Delivery or withdrawal of Prizes

After verification of the legality of the entry and the conditions for awarding the prize in question, the winners will be contacted by email. Winners will also be announced during a live broadcast on August 6, 2025 at 3:00 pm (Guadeloupe time).

At the end of a period of 7 days, without a response to the e-mail inviting the winner to communicate, the prize will be lost. It may be awarded to another participant drawn at random, or will remain the property of the organizing company.

Incorrect e-mail address, incorrect postal address: (information by e-mail) If the e-mail address is incorrect or does not correspond to that of the winner, or if for any other reason related to technical problems not allowing the correct routing of the information e-mail, the organizer cannot under any circumstances be held responsible. Similarly, it is not the responsibility of the organizer to search for the contact details of winners who cannot be reached due to an invalid or illegible e-mail address.

Unclaimed prizes: Winners who cannot be contacted, or who do not reply within 7 days to provide their address, will not be entitled to any prize, compensation or indemnity of any kind whatsoever.

The prizes awarded are personal and non-transferable. In addition, the prizes may not be contested in any way whatsoever by the winners, nor may they be exchanged or given in exchange for any other consideration whatsoever.

Article 8: Collection of information - Data Protection Act

The personal data collected as part of participation in the game are recorded and used by the organizer for the purposes of their participation and the awarding of their winnings.

Participants may ask not to be included or to be removed from the file at any time, they will benefit from a right of access to rectify and delete data concerning them by simple request to the game address in accordance with the Data Protection Act of January 6, 1978, amended by Law No. 2004-801 of August 6, 2004 on and the General Data Protection Regulation (RGPD) on the protection of individuals with regard to the processing of personal data and Decree No. 2005-1309 of October 20, 2005.

Persons who exercise their right to have their data deleted before the end of the game will be deemed to have waived their right to participate.

All requests must be sent by post to the organizer's address mentioned in article 1.

The personal data collected by the organizing company (surname, first name, postal address and e-mail address of participants, etc.) during participation in the competition are collected and processed solely for the purpose of organizing and running the competition, and in particular for the purpose of awarding prizes. They will be stored and kept only to ensure the smooth running of the game and for a maximum period of 6 months from the close of the operation. A box will be provided for participants to give their explicit consent to the retention of their personal data for communication purposes beyond six months, in accordance with the requirements of the General Data Protection Regulation.

For the organization of the Game and for the sole purpose of contacting the Winner, the Organizing Company will have access to the personal details of the Participants, the Winner and the Beneficiary. In accordance with its privacy policy https://www.valombreuse.com/donneespersonnelles /, the Organizing Company may communicate the personal data of each Participant to legal authorities in order to respond to an injunction or other request from such authorities.

Article 9: Liability

The Participant acknowledges and accepts that the sole obligation of the organizer in respect of the Game is to submit the entries received to the decision of the draw, provided that the Participant's entry complies with the terms and conditions of the Rules, and to award the prizes to the winners, in accordance with the criteria and procedures defined in these Rules.

The organizer cannot be held responsible, without this list being limitative, for any malfunction of the "Internet" network preventing the smooth running of the game, in particular due to external acts of malice. The organizing company shall also not be held liable in the event that one or more participants are unable to connect to the game site due to any technical fault or problem related in particular to network congestion. The organizing company makes every effort to provide users with available and verified information and/or tools, but cannot be held responsible for errors (in particular display errors on the game sites, incorrect e-mails sent to participants), lack of availability of information and/or the presence of viruses on their site, or any malfunction of the Internet network preventing the game from running smoothly; interruptions, delays in data transmission, failures of the player's computer, telephone, modem, telephone line, servers, Internet service providers, telephone operators, computer equipment, software; the loss of any electronic mail and, more generally, the loss of any data, the consequences of any virus, computer bug, anomaly, technical failure, any damage caused to a participant's computer, any technical, hardware or software failure of any kind, preventing or limiting the possibility of participating in the game or damaging a player's system. It is the responsibility of all participants to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack. Any person connecting to the site and taking part in the game does so under their own responsibility.

The organizing company may cancel or suspend all or part of the game if it appears that fraud has occurred in any form whatsoever, including computer fraud in connection with participation in the game. In such a case, it reserves the right not to award prizes to fraudsters and/or to take legal action against the perpetrators of such fraud.

In all cases, if the proper administrative and/or technical operation of the game is disrupted by a virus, computer bug, unauthorized human intervention or any other cause beyond the control of the organizing company, the latter reserves the right to interrupt the game.

Likewise, participation in this game implies knowledge and acceptance of the characteristics and limits of the Internet in terms of technical performance, response times for consulting, querying or transferring information, the lack of protection of certain data against possible misappropriation or piracy and the risks of contamination by any viruses circulating on the network.

Article 10: Force majeure / Reservations

The organizer cannot be held responsible if, due to force majeure or beyond its control, the game has to be modified, shortened or cancelled.

The organizer reserves the right to carry out any checks it deems necessary to ensure compliance with the rules, in particular to disqualify any participant who has made an inaccurate, misleading or fraudulent statement.

Article 11: Invalidity - Dispute resolution

Should one or more of the provisions of the present Rules be declared null and void or inapplicable, the other clauses shall retain their full force and scope and shall in no way affect the validity of the Rules themselves.

The Rules are governed by French law without prejudice to any conflict of laws rules that may exist. Participants are therefore subject to French regulations applicable to games. Any difficulty in applying or interpreting the Rules will be settled exclusively by the organizer.

No telephone requests or complaints concerning the application or interpretation of these rules will be answered. Any dispute or claim relating to the Game and/or the draw must be made by registered letter with acknowledgement of receipt to the organizer's address. And no later than ninety (90) days after the closing date for participation in the Contest as indicated in these rules. In the event of persistent disagreement on the application or interpretation of the present rules, and in the absence of amicable agreement, any dispute will be submitted to the court having jurisdiction, to which exclusive competence is attributed.

In order to ensure equal opportunities for all participants in this Game, the Organizing Body reserves the right not to award the prize to fraudulent entrants and/or to prosecute the perpetrators of such fraud before the competent courts: in particular Article 323-2 of the French Penal Code (amended by Law no. 2004-275 of June 21, Art. 45 II, Journal Officiel of June 22, 2004): "the act of hindering or distorting the operation of an automated data processing system is punishable by 5 years' imprisonment and a fine of 75.000,00€ fine".

Article 12: Submission and consultation of the Regulations

The present rules are deposited via depotjeux with the office of Maitre Doniol located at 7 rue Jean Jaurès - 77410 Claye Souilly, bailiff.

The rules may be consulted free of charge for the duration of the game at the following address: http://www.depotjeux.com/. Participation in the game implies pure and simple acceptance of the present rules in all their provisions, as well as the laws and regulations applicable to competitions in force in France.

The rules may be amended at any time in the form of a rider by the organizers, in compliance with the conditions set out, and published by online announcement on the site. The amendment is filed via depotjeux with the office of Maitre Doniol located 7 rue Jean Jaurès - 77410 Claye Souilly, bailiffs, custodians of the rules before publication.

It will come into force as soon as it is posted online, and all Participants will be deemed to have accepted it simply by taking part in the Game, from the date on which the modification comes into force. Any Participant refusing to accept the modification(s) shall cease to participate in the Game.

Article 13: Industrial and intellectual property

The reproduction, representation or use of all or part of the game's components is strictly prohibited. All brands or product names mentioned are registered trademarks or product names of their respective owners.
